Legal Question in Family Law in New York

my divorce is pending but we had signed a separation agreement and it was in that agreement that child care be shared equally. he has been giving me the correct amount for the past 6 months but has said that he cannot pay his rent and does not have money to give me for the babysitter, he can only give me half. my daughter is 2 and half and is not potty trained so iam not putting her on day care. what should i do, should i go to family court and will i win

You may file a petition with the Family Court to enforce the father's obligation under the separation agreement for daycare.
