Legal Question in Family Law in New York

After divorce

Prior to my divorce my wife took my kids out of our md home and with the collusion of her parents, moved to ny state. I had no idea that this was going to happen, nor did I agree to it. Is it true to say that she committed an illegal act? If so, is it kidnapping? If yes, what is the statute of limitations on filing charges against her? This happened 4 years ago, and we have since been divorced.

It may not be beneficial to bring a kidnapping charge when it comes to gaining rights of visitation. If the children have resided with their mom for 4 years you may have difficulty with gaining custody. A visitation agreement should be sought or you may have to file for this in the court.
