Legal Question in Family Law in New York

Divorce Settlement

My ex-husband (who has his own business) claimed he had no assets at the time of our divorce. I received a small amount of assets from the company and a low maintenance and child support which was based on the Income Tax Returns and business returns he submitted to the court. Shortly after the divorce was final he closed on a $1.5 million dollar house. Obviously he had assets somewhere. Is there anything I can do now to increase amount of money I was awarded?

Re: Divorce Settlement

Interesting. In New York State both spouses must file a 236b financial affidavit detailing assets.

Furthermore, when he applied for a mortgage, he must have filled out a financial statement listing his assets.

If the two of them are different, your ex would have committed perjury on one or the other document.

You also could bring him back to court and have the maintenance, distribution of assets, and child support reviewed right from the beginning.
