Legal Question in Family Law in New York

Divorce In New York

I need some advice on my current separation / divorce, I filed for a divorce November of 2005 (Buffalo, New York)

On May 16th, 2006 the paperwork was signed for what I assumed was both the separation, property settlement agreement. Now here are my questions.

1. When can I file for the divorce, is it the date I signed the papers, (one year and one day) or when she got her settlement money and moved out 60 days later, + one year and one day.

2. Can she get any more money/ fees from me as long as I have substantially complied with all terms of the agreement.

Re: Divorce In New York

You initially said you filed for divorce in 11/05. If you filed for divorce then, then if it was a property settlement agreement you signed then you could have completed the divorce at that time. The one year is from the date of filing if it were in fact a separation agreement. If all of the terms were complied with then the separation agreement should be converted. Unless she has proof that there was not full compliance then the divorce can be contested.
