Legal Question in Family Law in New York

I was divorced in 2006. At the time, my ex husband was on social security disability and I was receiving money for my kids. In my divorce agreement, he was also to pay the monthly payment on the home equity loan. Last year, he got a job, informed social security and the payments stopped this past month. He now claims he cannot make the home equity loan payments AND pay me child support. When I told him I was going to take him to Family Court, he told me he was going to claim bankruptcy and take my house away from me. In my papers, I live and pay the monthly mortgage on my home. Can he do this? What recourse do I have? Thank you.

YOU NEED TO SEE AN ATTORNEY IMMEDIATELY! He is threatening you with several things that, if your settlement from the divorce was written properly, he does not have the ability to do.

The issues you raise are too extensive to answer in this e-mail. You can call my office for a free consultation or call any number of other qualified attorneys in the Nassau or Suffolk County area.

My number is 516-746-4747.

Do not wait. You need to protect yourself and your children.
