Legal Question in Family Law in New York

Father wants to sign off on parental rights

My son is 9 mths old. His father has made little effort to see my son since his birth. He recently told me that he wants to sign off on his parental rights. I am willing to allow him to do so as I feel it would be in the best interest of my son. Would the courts allow this? And if so how do I begin in approaching this matter?

By agreeing to this, you will no longer be entitled to child support. You need to see a local attorney

Re: Father wants to sign off on parental rights

The Court will allow a biological parent to consent, in writing, to the adoption of his or her child by another.

But, generally a parent DOES NOT have the right to "waive" a child's right to his parent with nothing more than a statement that it's in the child's "best interests."

A child's right to both parents is personal to the child.

Good luck,

Re: Father wants to sign off on parental rights

You and the father can enter into such an agreement. However, depending on your circumstances, the court might not release the father of his support obligation. You should consult an attorney as soon as possible.
