Legal Question in Family Law in New York

My fiance's ex is highly unreasonable. We are seeking to take a trip to Canada. We're not staying in Canada just crossing the border during the days while we visit Niagara falls. We've contacted him and he said no and then we contacted his lawyer and we did not get a response. Our lawyer is going to petition the court in New York State. Since he's perpetually unreasonable could we seek permanent permission if we are willing to give him reasonable notice?
