I filed for a modification and violation of child support

I filed for a modification and violation for child support. On first appearance (which my ex did not appear because a warrant for his arrest is active as a result of his failure to obey order of the Family Court after confirmation of willfulness was made on January 9, 2007) the magistrate said she will only hear the modification not the new violation which is @ 12,000.00 since January 9, 2007 because he has a warrant because he didnt pay the last violation purge amount of 33, 870.00. How do I proceed on the violation for the new arrears at least to get a judgment?

You can't do anything right now, if the SM won't hear it there is nothing you can do because the case will probably only go back to her if you file another petition. Although she can hear the current arrears for whatever reason she does not want to address those. Maybe you should speak with an attorney.
