filing realestate taxes for home

i am in the middle of a divorce ...the husband abandoned the home and children and i have been paying all taxes for home for the past last year..does he get to file head of house hold and file taxes for the home

You need to file separately and FILE FIRST! He has no statutory right to claim children.

You may want to file separately and claim the children as dependents on your filing. Talk to a tax attorney or accountant for more detailed information.
