grounds for divorce

married in 1985, seperated in 1986; have not seen spouse in 17 years; what should I do to obtain a legal divorce or do I need to obtain a legal divorce?

First you should retain an attorney. Then it should be determined if you can contact your husband and if he will consent to a divorce. These factors will determine the ease and cost of such a solution. You may contact my office for a consultation @718 834-0087.

This is a far more common situation than you probably imagine. I have two (2) such cases I am working on now - one of which will be successfully completed next Friday. The other is just starting and will take another 60 days.

This situation (where the spouse cannot be found after a long period of time) is not difficult, but it is time consuming. The method prescribed by the Law is 'service by publication'. Everything else in the documents is standard.

You do need a "legal" divorce. You can get one on the ground of abandonment. You should consult with a lawyer. If you do not know where your spouse is, you may have to serve the papers by publication in a newspaper which requires a court order.

If you would want to remarry, you would need a divorce, unless you can prove that your husband has died. In your circumstance getting a divorce is relatively simple.
