Legal Question in Family Law in New York

What has to happen for grandparents of young two-year-old boy to legally be able to start the process for adoption. The father has agreed to adoption. The mother, has overdosed on drugs and is in the hospital and the prognosis is a three- year recovery to relearn to walk, talk, etc. She seems to have some coherency and understanding, but her brain functioning has not yet been determined. Does the mother have to agree to adoption too, before the child can be placed? Any help appreciated.

Very sad situation.

Yes, the Mother has to consent.

Perhaps you should petition for guardianship until the Mother regains her mental capacity.

You should get an attorney.
