Legal Question in Family Law in New York

Hi,

I live in NY and my child is 18. He will be going to college in the fall, but he wants to live with me when he is home. Does this make me the custodial parent? If so, do I have to continue to pay child support?

The choked living with you does make you the custodial parent, but this has yet to occur... When it does i would suggest filing a petition for modification of your previous support order.
