Legal Question in Family Law in New York

My husband and I are divorcing and have one child together. Both our names are on the title of the house. In the event of his passing and no wills are set up, who is in charge of handling his estate, or better yet, who will control his share of the marital property?

The answer to this question all depends on what the final divorce decree agreement is. Right now you are still married and still share the asset.
