Legal Question in Family Law in New York

My Husband and I separated (physically, not legally MONTHS ago) I gave him grounds for divorce and filed the paperwork to the best of my ability. He has not filed yet so I am wondering how I can go about getting a legal separation so I can file for divorce myself. He has moved out and has his own apartment. We were going to file an uncontested divorce and agreed on the terms but he is dragging this out and I'd like to know how to go about getting a legal separation as soon as possible.

You can file an action for a separation.

I am a little confused by your question. You write that you filed paperwork (to the best of your ability), yet you write that you want to file for divorce yourself. What did you file?

If this is for an uncontested divorce, you may want to contact an attorney. Most attorney's (including my office) handle uncontested divorces for a flat fee.

Mike.
