Legal Question in Family Law in New York

information please

Please I need all info on tropea v. tropea and hehehan v. henehan. Also this judge has shown bias how do I proceed to change judges or move my case to mediation. I'm the custodial parent father of a 7 yr. old daughter my ex wife is mentally ill and has also lost custody of another daughter from a previous marriage.

If you are trying to relocate far from the non-custodial parent's residence you will need to show all of the reasons why the best interests of the child ( not you) are better off in the new location. Both cases you cited Tropea and Henehan deal with the Court's decision-making process. In general when reviewing a custodial parent's request to relocate, each relocation request must be considered on its own merits with consideration to the unique facts and circumatances of the family dynamic, so that the Court can determine what location serves the best interests of the child. This is the difficult type of case that probably requires that you retain an attorney-- more so if you have already moved away because the Court may require you to move back or lose custody.
