Legal Question in Family Law in New York

If the judge says that a person shall obtain a mental evaluation before starting to have supervisioned visitations to her kids and she can't afford to it, does the government helps to pay for the treatment with any kind of financial or indicates a psychologist for free for this person?

I am not 100% sure about your legal situation in this limited forum but speak with an attorney (or e-mail me at [email protected]). A new divorce law went into effect Oct 12, 2010 where the less monied spouse's legal fees (or a portion thereof) are to be paid by the more monied spouse. The legislators were concerned that the less monied spouse (most often, the wife) did not have her rights protected because she could not pay for a lawyer and was thus run over by the husband and his attorney. I would argue that a psychologist is part of your rights "package" and/or I would ask for the court to assign a court-appointed law guardian for the kid(s), at the husband's cost.
