legal child custody

My daughter had a baby with her boyfriend and has now left him due to physical abuse by him on her. How does she get legal custody of her son who is living with her?

She has de facto physical custody. She should be making application to the Family Court for child support. Each Family Court has an intake room to help her with the petition for support.
