Lost Child

ex-wife had an affair, ordered a restaining order against me with no visitation rights, devorced me, moved away and now she has changed the childs surname siting child abandonment. Is this legal?

This does not sound legal. I would want to see how she accomplished this, because she would have had to do more than mere perjury to do it in NY. Forging documents would also be required.

If you know the location of both her and your child, then you have a strong case to get the name change set aside and possibly an order to have her move back to a location where you could enjoty visitation.
