marital asset distribution+alimony payment

married 4 years in NYC. we have one child together, 2 years old. i have grossed, on average, 300,000/year for the past 4 years. we have 700,000 in assets to divide that has accumulated while we were married. assuming we split this 50/50, what are the chances that my spouse will still be entitled to alimony? currently, she is claiming that she needs appx $4,000/month to maintain the lifestyle she has had....but does this weigh heavily in a short term marriage? when we get divorced, is she really entitled to have the same life she had when we were married? won't the 350,000 be sufficient enough for her to subsidize her income to maintain a lifestyle? she has only worked part time (3 days/week) and i have paid for a babysitter 5 days/week. are the odds in her favor that she will still only have to work 3 days a week while i pay for a full time babysitter and alimony payments?

You ask good questions but these issues are usually case specific and depend on more information than you could post in a question. You should make sure that you are represented by an attorney who specializes in matrimonial law. If you already have such a lawyer, you should be discussing these questions with him/her. The duration of the marriage is one of several factors to be considered in determining maintenance (alimony). The Court has significant discretion in drafting such relief, however, so you should consult an attorney experienced in matrimonial/family law as soon as possible to lay the groundwork prior to litigation.
