I am married to a man who has legal cus of his son if he goes to jail can i keep my step-son?

Where is the mother of this child?

Has she been declared unfit?

If not then she may want the child.

I would imagine that the mother or another biological relative of the child would also seek custody.

You can petition to adopt this child, but the biological mother as well as the child's aunts, uncles and grandparents may also do the same.
