Legal Question in Family Law in New York

Just before I married my wife 11 years ago (we are still together) she admitted she was pregnant with another mans child. He realized at that time that he was the father and chose not to make contact for all of these years. Now he has asked for a paternity hearing. We must appear in court at the end of Sept. What is the worst case sceniaro? Can they give him custody? Visitation? What if my daughter doesn't want to see him? Also, I can't afford an attorney, but I need one. Please help

The court has to consider certain factors before even granting the application for the paternity test. The way I see it, the worse case scenario is that the court grants the paternity test, he is confirmed as the biological father, and the court enters an order for theraputic supervised visits. However, taking your daughter's age into account and the emotional strain of finding out that you are not her father, it seems unlikely that the court would even order the test. I really couldn't see the court granting him custody unless there was some drastic turn of events. However, you need to consult an attorney about your particular situation. Most family law attorneys give free consultations. Good Luck!
