What you are entitled to depends not upon whose name the house is in but on the specific circumstances of your situation. Did he own the house prior to the marriage? Was there a mortgage or taxes during the period of the marriage paid for with marital assets, such as salary received during the marriage? Did you as the spouse make contributions to the increase in the value of the property?

These factors dictate whether you are entitled to a share of the value of the house, and, if so, what the amount of that share will be.

You should consult a qualified matrimonial attorney to discuss your situation. The cost of the consultation will be far less than the cost of making a mistake when you try to do this yourself.
