Legal Question in Family Law in New York

non custodial parent wants unsupervised visits

Currently we have joint custody, we are married, I have sole physical custody.Supervised visits were est through the courts due to a family offense petition.Visits are at my home, supervised my child's family member.I have had to arrange the supervision, which are frequently cancelled last minute. Now difficult to find supervision due to fathers attendance. It is inconvient for my family.Father refuses to bring his own, or arrange visits. At visits, which on occassion I have to supervise, he is intimidating, verbally and emotional abusive.Last visit I was the same, and he left.He has not returned for any visits nor called to advise.A mutual friend states he is taking me to court for unsupervised visits. He was ordered to attend 52 wks DV couselling & 26 wk parenting classes before he could have unsupervised visits. He has not taken, nor signed up.I don't want to stop the visits, but I am not comfortable and do not feel safe.Legally, what can I do to change the visits to a safer location for my daughter and I?Can I keep them supervised?Would letters from family help?also, He was removed from the home by police & court order(11/2007), when can I file for divorce?

Re: non custodial parent wants unsupervised visits

Your divorce action would most likely be filed in the county in which you live. You should contact a family law attorney in your area to arrange a consultation on your divorce and on the question of visitation.
