Legal Question in Family Law in New York

NY custody question

Non-custodial parent (father) is active military and currently deployed. Can custodial parent (mother) assign custody to someone other than non-custodial parent (ie her parents) so that she (custodial parent, mother) can join the army? I know that a single parent cannot enlist in the military (except for the army national guard reserve) unless she signs over custody of his/her child(ren) to someone else.

It would be best (and you really should) get consent from the father. However, I have seen situations where the custodial parent assigns her custodial duties to others where both parents are deployed.
