Legal Question in Family Law in New York

order of protection and joint custody

My husband beat me tried to kill my children and i in June 2000. He spent 3 months in jail, now out on 5 yrs. probation, mandatory psych, batterers and drug classes. I have criminal stay away order of protection. I petitioned for full custody. He cross petitioned for joint and is now motioning to have OOP amended....I have not been served notice of this yet. He has not questioned if we have sufficient funds for food or heat, yet has picked up clothes and tools. He has private atty, I cannot afford atty. I have tried to do my homework and have found much helpful info in CPL. However, I would like to be able to research quoted cases. Is there any place I can look up said cases? Do you see any hope to keep this psycho away from my children? Police have my home alarmed to precinct and DA's office will help me all they can. thanks so much.

Re: order of protection and joint custody

With regard to the issue of research, each county in New York has a law library that is open to the public. Usually the library is located in the Supreme Court Building and is open from 9 to 5.

You may also qualify for a free attorney. I suggest that you contact your local bar association for assistance.

Mike.
