Legal Question in Family Law in New York

Parent has primary-joint custody with ex husband. 16 year old does not want to come back to mother because she gets to see her boyfriend while with the father. Mother wanted to know if her daughter has the right to do stay at her fathers if she wants her to come back home.

Under the law a 16 year old cannot make decisions regarding her own custody. If you have residential custody and the father has a schedule of visitation then that is the law. As far as enforcing the order, that is another matter. It is recommended that you speak with a family law attorney on this subject.
