Legal Question in Family Law in New York

Process Serving on Divorce Petition

My boyfriend has filed for divorce in Texas. He is military and considered a resident. His wife lives in NY with their 10 month old child. She has received the petition and did not answer. He is serving her notice and hoping for divorce by default per Texas law in 20 days upon receipt, should she still not answer. She recently asked for his address to have him served. What can she possibly serve him with? Can she file for divorce if he already has? She can't possibly serve him with his own petition?

Re: Process Serving on Divorce Petition

She maybe filing for child support. Her failure to respond to the divorce does not absolve from paying child support.
