Legal Question in Family Law in New York

Quadro on a Federal Pension

Married 1974, legally separated 1198. Legal separation staes I receive 30% of pension @ retirement. Husaband retired last yr, I am in process of having a Quadro drawn up. My question is am I entitled to survivor benefits? He selected survivor benefits when he retired last year But they are not addressed in the legal separation. Also is there anything special I should know about a Quadro on a Civil Service Retirement Pension?

Re: Quadro on a Federal Pension

Your question requires careful reading of the separation agreement. It is not only the clause on retirement benefits but also any clause covering the right to waiving spousal rights under a will or the intestesy laws. You should have an attorney read the document and consult on this matter.
