Recordings

Is it illegal to have tape recorders in your home to try and gather information? If you are in your own home with your spouse and taping conversations would that be illegal? Would that information be admissable in court?

If you set the tape recorder to tape conversactions while you are not in the room, that is illegal. Generally, the law in NY is that 1 person must consent to the taping. Therefore, if you have a tape recorder on your person while walking around in the house, that is legal.
