Rights of the Biological Father out of Wed-Lock

I would like to know what rights does the biological father has pertaining to a child born out of wedlock. The mother has full custody and has begun the process for child support. but there is no court ordered visitations set up and he is a on again off again type of father when it comes to doing the right thing. Can he be X out of the picture and can her new husband be given rights or custodial rights without the consent of the BIO Father?

You sited no facts that would cause a court to terminate the bio-dad's parental rights. Bio-dad can voluntarily give up those rights and allow your new husband to adopt.
