If your spouse has custody of the unemancipated child, you will need to pay 17% of your gross income for child support. Also, if you divorce, you are entitled to the following: (a) most likely spousal support (alimony), (b) 50% of the house, (c) 50% of her pension and any other retirement such as 401k, (d) most likely payment of your lawyers fees if she contests the divorce, and (e) 50% of all marital property. There may also be additional things you are entitled to depending on the specifics of your situation. Do NOT file for divorce without consulting a matrimonial attorney, and contact a lawyer immediately if you are served with divorce papers. Feel free to contact me if you want to talk. 212-913-9907.
