How do i go about getting sole custody of my daughter. My ex lives in a different state and still receive child support?

To get an accurate answer you will need to provide more detail. Assuming that your daughter and you are both in NY, you can bring a custody proceeding in NY. As for child support, to terminate a child support obligation where the order was initially issued in NY and you still live in NY, you can bring a support modification or termination proceeding in NY family court even if your child lives in another state.
