Legal Question in Family Law in New York

a spouse who won't leave

For reasons of addiction and verbal abuse, I have been trying to kick my husband out of our house. We have four children and I own a business out of our home. Simply put, he won't leave. What can I do legally to force him out?

You could go to Fam ct and petition for Order of Protection with a vacate provision.

You will be required to prove his abuse and behaviour while he is under the influence.

If you can prove and show abuse and addiction, you can file for order of protection in Family Court.
