Legal Question in Medical Leave in New York

i have apporved fmla through work. i have used about 5 weeks worth at different times since approval. my employer now wants to put me on "probation" for missing work and possibly terminate me at the end of the probationary period if they arent satisfied with my attendance/performance. can they do that???
