Legal Question in Medical Leave in New York

i'm an only child and my mother passed away recently, their was some property sold belonging to my mothers brother,who is entitled to this me or my moms hubsnd. they lived in new york, i live in va.

If she had a will, look at the will. If she died without a will, her husband will be entitled to the first $50,000. Thereafter, he is entitled to 1/2 of the balance of the estate. As the only child, you would be entitled to the other 1/2.

If you believe your mother's net estate is greater than $100,000, you might consider hiring an attorney. I say $100,000 because for a $100,000 net estate, you would be entitled to $25,000. The attorney's fees would cost anywhere from $5,000 to $15,000 (at the minimum). Therefore, with everything taken out, you would be entitled to approximately $10,000 to $20,000, which may be worth fighting for in this matter.
