Legal Question in Medical Leave in New York

One of my co-workers just had a baby and is scheduled to return to work next week. Although our agency participates in the fmla they are demanding and threatening that she returns to work or she will risk losing her job. I just need some more information on this act. Thanks

FMLA is a negotiated leave for a serous illness. IF the employee fails to return at the end of the FMLA time off then the employer may terminate her position.
