Legal Question in Medical Leave in New York

Family Medical Leave Act

I have only been with this company since May 15, 2007. I have been sick and out of work, tests have and are being done. I could possibly have cancer. I asked to be put out on medical leave and to start disability benefits. Instead, I was terminated in an e-mail. What recourse do I have now???

Your right to FMLA leave is dependent upon how long you have been with the company and how many employees are employed by the company.

Although you may not have been entitled to FMLA leave, your firing certain raises questions about disability discrimination and other issues.
