Legal Question in Civil Litigation in New York

can a car be a gift

My ex girlfriend bought me a car 3 years ago and now we are breaking up. She wants the car back she says that it was not a gift. I had her put in writing that if we ever broke up she would not ask for the car back. The car is a 48,000 car, but now is worth about 28,000 from the blue book. do i legally have to give the car back to her? if i dont what laws are protecting me?

Re: can a car be a gift

Can't give yo a definitive answer. Exchanges between unrelated people are presumed not to be gifts, you would have the burden of proving the car was a gift. If you have this written document it could be evidentiary but not determinative.
