Legal Question in Civil Litigation in New York

A driver of a dump truck had a tire fall off his vehicle and it smashed a section of wooden fencing on our property. It also hit our propane tank. What am I entitled to? I've heard that he's responsible for just the section of fence that was damaged and I've also heard that he's responsible to replace the entire fence.

I would think it depends on the fence. If you can replace the part that is damaged so it matches the entire fence, then he would only replace that part. Otherwise, he should be made to replace the entire fence.
