Legal Question in Civil Litigation in New York

On monday I took the tires off my truck and listed them on craigslist. On friday a guy wanted to purchuse them. We ment and he inspected them and bought them. The next day he called and said they will not install them becouse of cracks in the tread. Now he wants his money back. threating small claims court. I went to my tire guy and told him this and he told me these cracks are normal in BF Goodrich tires after a couple years. the reason we took the tires off was becouse my son now drives this vehicle and his freind had lt rated used tires for sale and the ones we took off were passenger rated. These tire had been on this vehicle since they were new.

If you covered up the cracks with shoe polish, you would be liable. Otherwise, the rule is Caveat Emptor: let the buyer beware.
