news crews

if a group of people are having lunch at a public lunch restaurant, is a news crew allowed to enter the establishment and film the people having lunch as a followup on a story - without getting permission? Would the stablishment be liable if this happened? Would the news crew be liable ?

Generally, people out in public can't expect that they won't be photographed/seen. But famous people have less expectation of privacy in public and regular people. It will also depend on the topic of your report and whether or not any of the customers believe the are being connected to something that is in appropriate and harms them. If someone insist that you not show their image, you should check with an attorney before you use it because that person has put you on notice that they object and you will be considered as having had the opportunity to reconsider your actions. What you describe wouldn't necessarily be enough notice to the owner of the establishment that a customer would be harmed. But an attorney would need to know more facts to give you an answer you could rely upon.
