Legal Question in Civil Litigation in New York

I am a plaintiff pro se for a case filed with a NY supreme court. I am a little bit nervous because I do not have much experience in pro se litigation. Any way, I served a summons and verified complaint on a defendant. Then a few days later, an attorney who said was retained by the defendant called and e-mailed to introduced himself to me (and we exchanged standard pleasantries). By this action, their potential affirmative defense of not being properly served is waived?
