Legal Question in Civil Litigation in New York

Help Police~ I'm being robbed!!

Over a a year ago my motorcycle was

struck in the rear. There were NO

damage to the other vehicle ,as stated

in the police report, though my

passenger was injured when struck. I

have now received (and answered) a

summons to civil court~ and I am being

sued for non-existant damages to thier

vehicle??!! The claimant, I might add, is

my co-defendant in the case with my

passenger. My question is whether or

not these cases can be attachd in some

way, since they seek to answer the

same question of ''fault''?

You may well end up being robbed if you try to handle this on your own. First, you should contact your insurance carrier, if you have one. Second, you should contact an attorney who will represent you. Chances are your insurance will pick up the cost.

Do not delay - the other side will have an attorney, and trying to represent yourself in this kind of a matter is almost invariably penny wise and pound foolish.

You can attempt to have these two cases consolidated, since they involve the same issues of law and fact with respect to the happening of the accident and liability. If you are being represented by counsel in the personal injury action they should be made aware of this other lawsuit. Also, you should immediately put your insurance carrier on notice of this property damage lawsuit. If you have any other questions regarding this matter, please feel free to contact me.
