Legal Question in Civil Litigation in New York

May I sue someone who hit my parked car? Last week my parked car was hit by a drunk or sleepy driver. I went though the drivers insurance for the claim but my vehicle was deemed a total loss. I was given about $1800 less than what was left on my loan. Therefore I had to pay this out of my pocket. Nonetheless I just bought the car in July 2013 and had put down a $4000 trade in down payment therefore I feel as if I lost money in this. This entire ordeal of having to go out and buy a new car has been a headache and stressful since I didnt have enough to make a down payment on another car! I even had to pay the difference for my car rental (about $100). Is there anything I can sue for? Is it even worth it?

Yes you can sue. It's a classic small claim case. You have the bad guy's insurance, don't you?
