Legal Question in Civil Litigation in New York

venue for liltigation

I live in Dutchess County, New York and I recently purchased carpeting from a carpet store in Canton, Connecticut. Their installers left my newly renovated home with extensive property damage, and I would like to bring a legal action against them.

My question is: can I use my residence in NY as the basis of venue for a lawsuit, or must I bring suit in Connecticut where the carpet business is located?

Your lawsuit could be initiated in either New York or Connecticut - your choice.

New York's courts have long arm jurisdiction when a foreign (out of state) business is doing or transacting business in New York state. So you can sue in NY.

You should file in Dutchess County Supreme Court if the damage exceeds $25,000. Otherwise, file in your city court. I have an office in North Westchester if you would like to come down and further discuss this matter.
