Legal Question in Civil Litigation in New York

My wife had a friend of hers move in with us while she went to college - the girl was financially strapped my wife wanted to try to help her. She recently moved out wife is upset because she can't find a lot of stuff. I should add that my wife suffers from BiPolar disease and was recently hospitalized d/t an overdose. since the OD she has had some serious problems with her memory and confusion. I know some of the things she is saying are gone are missing but I don't know exactly what happened to them. My wife swears the girl took them But I'm hesitant to pursue things given my wife's current mental status should she just cut her losses?

Check your insurance. You may have theft coverage. I agree that if your wife has BPD Grade III/IV, the last thing you want is to stress your wife out. But filing a theft claim also requires filing a police report.

If your wife is an outpatient, then I have to think she has calm intervals from time to time. That might be a good time to discuss the issues with her. She needs to believe that she still has some control over her life (unless she's an inpatient or an every day day patient, in which case she needs to accept her impairment and work on getting better).
