Legal Question in Immigration Law in New York

I am a US citizen. My fiance applied for refugee status in France. The decision is pending. We are planning to get married. How will this affect him becoming a US legal resident?

If you will be petitioning for his Fiance or Spousal or Immigrant visa, and he'll be moving to USA, thus, he'll abandon his asylum claim in France. However, normally, this should not affect his U.S. visa application provided that he has all required documents.

It should not affect him at all. His application for permanent residence would be based solely on his spousal relationship with you, not on his need for asylum or other refuge.

Please note that since you already have an intent to get married, you must be careful to follow the correct procedures regarding which visa to apply for.
