Legal Question in Immigration Law in New York

My dad was put in prison, served time and was deported to Ghana. He re-entered before his 10 years was up under another name. About a year ago on return from Ghana he was detained and brought back to prison. This monday january 26, 2011 he had court and to me his public defender was infective. She without him knowing gave him an additional year to serve amongst other things. the judge felt that it was not needed gave him 6 more months and deportation. i wanted to know if we can challenge the case or anyone that can help me

You certainly have a difficult, if not impossible case to resolve. One thing you must know in immigration law is, any time you challenge the ruling of a judge, you must have a good reason under the law to do so. From the limited information you have provided, it seems your father do not have any strong defense for his act. From the information you have provided, I don't think your father will qualify for an adjustment of status or a cancellation of deportation. At best, he will need a waiver to clear all the illigal issues you have listed, ie, not completing his 10 years stay in Ghanan and coming to the US under an assumed name. In my best judgment, it will be an uphill task to clear. My best advice is, save all the money you intend to spend on lawyers in your father's defense and give that money to him to re-settle in Ghana and I am sure he can make it there with your support.
