Legal Question in Immigration Law in New York

EAD form I-765 Application

Hello Sir/Madam:

I came from the Philippines under L2 (spouse of L1) visa last January 26, 2007. I'm planning on applying for employment authorization from INS. The form required (I-765) requires a Social Security Number. Upon arrival in the U.S., I applied for SSN but my waiting time is about 12 weeks.

My question is: Can I still apply for Employment Authorization despite the fact that I still don't have my SSN?

Thank you very much!

Respectfully yours,

Raul

Re: EAD form I-765 Application

One does not need an SSN to apply for an EAD. In fact, SSA probably would not issue an SSN to an L-2 without a valid EAD or other proof of eligibility for employment. The form only asks if you had an SSN previously issued while in a different status.
