Legal Question in Immigration Law in New York

My exwife had full custidy of my daughter. Then she was deported to Dominican Republic and my daughter went with her. Now my daughter came back to Tampa, FL. She has being there since December 2011. I am in NY. Who has the legal custudy of my daughter?

Well that depends if your wife illegally returned to the U.S. after her deportation. If she did, not only can she not have legal custody of your daughter in the U.S.- she's not even supposed to be here. (In fact she would have committed a federal crime of -re-entry). Now, assuming your daughter is here alone and not with her mother, then you, certainly as her father, can petition the court where you reside in NY for custody of your daughter. We can help.
